SAN FRANCISCO - The Ninth Circuit U.S. Court of Appeals on March 12 affirmed a portion of a trial court's decision allowing an insurer to assert policy defenses against the builders of an allegedly defective home but reversed a part of the ruling that found that collateral estoppels applied in relation to underlying litigation (American Family Mutual Insurance Company v.
